He specializes in representing employees in class action wage/hour and discrimination cases, as well as individual discrimination cases and other employment matters. Additionally, he serves as Co-Chair of the firm’s Public Interest Committee.
Currently, Mr. Swartz is actively involved in litigating cases that challenge the practice of classifying workers as independent contractors and failing to pay overtime compensation. He, along with Outten & Golden LLP\s Public Interest Committee, has represented numerous low-wage workers in minimum wage and unpaid overtime cases. This includes construction workers, farm workers, and low-wage cleaning workers who were not compensated for their work cleaning buildings around Ground Zero in 2001.
In addition to wage/hour cases, Mr. Swartz has also represented workers in employment discrimination claims. These include cases against companies that have discriminated against minorities with criminal records, systemic gender discrimination claims against major utility companies, and individual cases of race, gender identity, sexual orientation, and national origin discrimination. He has also represented female and African American stock brokers in discrimination class action lawsuits against top brokerage firms.
Mr. Swartz is known for his work with non-profit organizations on public interest matters. He has successfully represented a formerly incarcerated security guard in a licensing hearing in partnership with MFY Legal Services. He has also worked on cases involving low-wage immigrant women in sexual harassment, assault and battery, and overtime claims in collaboration with the ACLU Women\s Rights Project. During his time in Chicago, he volunteered at First Defense Legal Aid, providing emergency representation for recent arrestees and documenting police misconduct.
