After attending high school overseas, he returned to the US in 1980 and pursued a Bachelor of Science in Accounting at California Lutheran University in Thousand Oaks, California. Following his graduation in 1984, Fitzgerald began his post-collegiate career as a tax auditor with the IRS. However, he soon became dissatisfied with the inherent unfairness of the US Tax Code. In pursuit of a new path, he obtained a California contractor's license and worked as a contractor during the day while attending law school at night. Fitzgerald's hard work and dedication paid off when he graduated first in his class at Southern California College of Law in 1990. He passed the California bar exam and officially began practicing law in 1991. Initially, he worked for a small criminal defense/personal injury firm before opening his own law practice in 1992 in Orange, CA. Fitzgerald & Associates, his law firm, focused on representing individual consumers in a wide range of legal matters, including debt, injury, criminal defense, and tenancy issues. In 1998, he relocated his practice to Santa Ana, renamed the firm Fitzgerald & Malk, and expanded its services to include legal assistance for small businesses.
